Premium Texting Compliance Requirements

Before activating Neos Premium Texting, your firm's website must include compliant opt-in language on three pages: your Privacy Policy, your Terms & Conditions, and your Contact Us form. This article provides the required content and suggested templates for each page.

Neos uses Twilio as our integrated texting partner. A2P 10DLC is the federally-aligned compliance framework that governs business texting in the U.S. Twilio's review process is stringent, and rejection is common if requirements are not exactly met. Neos is not part of the legal review chain and cannot approve a campaign or override a rejection.

Opt-In Method Field

During activation, the Opt-In Method field requires a clear description of how your firm obtains client consent to receive text messages. The field requires at least 40 characters and can include up to 2,048 characters (including spaces).

A compliant Opt-In Method must include all of the following:

  • A clear explanation of the messages the client will receive

  • An unchecked checkbox (not pre-selected)

  • Company identification (your firm name)

  • Message frequency disclosure

  • "Message and data rates may apply"

  • STOP and HELP opt-out instructions

  • Links to your Privacy Policy and Terms & Conditions

For best results, use the example templates below.

NOTE: To submit a compliant opt-in method, updates to your website may be necessary. Updates to your existing Privacy Policy and Terms & Conditions webpages (or creation of those pages), accessible from links in the Contact Us form, are required. If you update existing pages, point the links in the Contact Us form directly to the respective SMS sections.

NOTE: If opt-in consent occurs via a paper form, a screenshot must be provided on a publicly accessible site (such as OneDrive, Google Drive, or Dropbox) with the URL entered in the Opt-In Method field. The screenshot should only include the consent information.

Suggested Opt-In Method Template

Use the following template as a starting point for the Opt-In Method field:

Privacy Policy Page

Your firm's Privacy Policy page must include an SMS Policy section on your website. Add the following content:

These messages may include case updates, appointment reminders, and important legal notifications. Message frequency may vary. Message and data rates may apply. You may opt out of receiving SMS messages at any time by replying STOP. For assistance, reply HELP.

Mobile information and text messaging consent data will not be shared, sold, rented, or disclosed to any third parties or affiliates for marketing or promotional purposes.

We may share limited information with subcontractors or service providers solely to support the operation of our SMS program (such as message delivery platforms or customer support services). These service providers are contractually prohibited from using mobile information for their own marketing or promotional purposes.

All other categories of information sharing expressly exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

This SMS Disclosure is part of our Privacy Policy and applies solely to SMS communications.

SMS opt-in is collected when a user provides their mobile phone number and affirmatively consents by checking the opt-in checkbox on our Contact Us online form. Consent to receive SMS messages is not a condition of receiving legal services.

[Firm Name] sends SMS messages only to users who have expressly opted in. Messages may include responses to inquiries, case-related communications, or service-related updates. Message frequency varies. Message and data rates may apply.

You may opt out of receiving SMS messages at any time by replying STOP to the number from which you received the message. For assistance, reply HELP for help.

Carriers are not liable for delayed or undelivered messages.

Contact Us Page

The Contact Us page of your website must include a selectable opt-in checkbox next to or under the mobile number field. The checkbox must not be pre-checked. Use the following text:

"I agree to receive text messages from [Firm Name] for case updates. Frequency may vary. Message and data rates may apply. Reply HELP for help or STOP to opt-out." (see image sample below)

The opt-in checkbox must include all of the following elements:

  • Clear Call-to-Action: A selectable checkbox that states what the user is signing up for (e.g., "automated text messages for case updates").

  • Company Name: Clearly identify who is sending the messages.

  • Message Frequency: Provide an estimated frequency (e.g., "will vary," followed by a typical range).

  • "Message and Data Rates May Apply": This phrase must be clearly stated.

  • Opt-Out Instructions: "Reply STOP to cancel, HELP for help."

  • Implied Consent is Not Sufficient: Even if clients call or visit your firm, you must obtain explicit, written (or digitally recorded) consent that meets these standards if you intend to send them SMS messages.
